1. Who we are

This website is operated by Designing Water LLC, a Florida limited liability company, doing business as Water Feature Pros, of 7750 Fruitville Road, Sarasota, FL 34240, United States. In these Terms, “Water Feature Pros”, “we”, “us” and “our” mean Designing Water LLC, which is the party you contract with. “You” refers to the person browsing this site or placing an order.

2. Acceptance of these terms

By browsing this site or placing an order you agree to these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree, please do not use this site. We may update these Terms at any time; the version in force at the time you place an order governs that order.

3. Eligibility and territory

You must be at least 18 years old and able to enter into a binding contract. We sell and ship within the United States only. All prices are in US dollars.

4. Products, finishes and natural variation

Many of our products are cast stone, cast iron, copper, GFRC or natural stone, and are finished by hand. Colour, texture, veining and patina vary from piece to piece and will vary from photographs, samples and screen images. This variation is inherent to the materials and is not a defect. Dimensions and weights are nominal and subject to normal manufacturing tolerance.

5. Pricing, quotations and errors

Prices exclude applicable sales tax, delivery surcharges and installation unless expressly stated otherwise.

Some products are sold by quotation rather than at a listed price. These are shown as Call for Pricing and cannot be added to the cart. A quotation we issue is valid for 30 days unless it states otherwise, and does not form a contract until we confirm the order in writing.

Despite our best efforts, a product may occasionally be listed at an incorrect price or with an incorrect description. We reserve the right to correct any such error and to decline or cancel any order placed at an incorrect price, whether or not the order has been confirmed and payment taken. If we cancel an order on this basis we will refund you in full.

6. Order acceptance

Your order is an offer to buy. Our acknowledgement email confirms that we received it, not that we accepted it. A contract is formed only when we confirm the order in writing or ship the goods, whichever happens first. We may decline any order, including where the product is unavailable, the price was stated incorrectly, or we cannot verify your payment or delivery details.

7. Payment

We accept Visa, Mastercard, American Express, Discover and JCB, together with PayPal, Venmo, Shop Pay, Apple Pay and Google Pay. Payment is taken in full when you place your order unless we have agreed a deposit with you in writing.

By submitting payment details you confirm that you are authorised to use the payment method. Payments are processed by our payment providers over an encrypted connection; we do not store full card numbers on our systems.

8. Cancellation of made-to-order goods

Goods that are made, cast, finished or configured to your order cannot be cancelled once the order has been submitted to and confirmed by the manufacturer. Production or shipping delays outside our control are not grounds for cancellation. Where cancellation is possible, it is subject to our Refund Policy.

9. Delivery, title and risk of loss

Delivery arrangements, freight terms and your obligations on receiving a shipment are set out in our Shipping Policy, which forms part of these Terms. Standard ground freight rates include curbside delivery by appointment. Unloading, and the labour and equipment needed to do it, are your responsibility.

Risk of loss passes to you on delivery of the goods to the carrier. Your ability to claim for transit damage depends on inspecting the shipment and documenting any damage in the manner set out in the Receiving Document we send you when the goods are tendered to the carrier. Those procedures are binding. Freight damage claims are limited to breakage; repairable chips, scuffs and abrasions are not a basis for a claim.

10. Returns

Returns, restocking fees and damage claims are governed by our Refund Policy. In summary: made-to-order goods are not returnable except where the model number or finish code delivered does not match what you ordered, and stock items require a Return Merchandise Authorization before they are sent back.

11. Warranties

Products carry the manufacturer’s written warranty, which is the only warranty that applies to them. We are a reseller and we do not give a warranty of our own.

Except for the manufacturer’s warranty, and to the fullest extent permitted by law, products are supplied “as is” and we disclaim all other warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

12. Installation, site conditions and safety

We sell products; we do not design, engineer or install them unless separately agreed with you in writing. You are responsible for confirming that your site is suitable — including load-bearing capacity, foundations, drainage, water supply, electrical supply, GFCI protection, grounding, permits and compliance with local codes — and for engaging appropriately licensed contractors.

Water features carry drowning, slip, electrical and freeze risks. You are responsible for supervision, fencing, winterisation and for maintaining the product in accordance with the manufacturer’s instructions.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, lost revenue, loss of use, property damage or the cost of substitute goods, arising out of or relating to any product or to these Terms, whether the claim is in contract, tort, strict liability or otherwise, and even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to any product or order will not exceed the amount you actually paid us for that product.

14. Intellectual property

All content on this site — text, photographs, renderings, logos, and the selection and arrangement of that content — is owned by us or by our suppliers and is protected by copyright and trademark law. You may not reproduce, distribute or create derivative works from it without our written permission. Manufacturer names and marks are the property of their respective owners and are used here to identify the products we sell.

15. Reviews and submissions

If you submit a review, photograph, testimonial or other content to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business. You confirm that the content is yours to give and that it is not unlawful, defamatory or infringing. We may remove any submission at our discretion.

16. Indemnity

You agree to indemnify and hold harmless Designing Water LLC, and its members, managers, employees and suppliers, against any claim or demand, including reasonable legal fees, arising out of your breach of these Terms, your misuse of this site, or your installation, use or maintenance of a product.

17. Events outside our control

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including manufacturing and supply chain disruption, carrier delay, labour disputes, severe weather, hurricanes, fire, flood, acts of government and utility failure.

18. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Sarasota County, Florida.

19. General

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies incorporated by reference, are the entire agreement between us regarding this site and your order, and supersede any prior discussion or understanding. You may not assign your rights under these Terms without our written consent.
